By visiting our website and/or purchasing products from us, you agree to these Terms of Service together with our Privacy Policy, Refund and Return Policy and Delivery Policy.
Please read these Terms carefully before using our website or placing an order.
Nothing in these Terms affects your statutory rights as a consumer under applicable UK law.
SECTION 1 – ONLINE STORE
Our website allows customers to browse and purchase products offered by Adam Afro Foods Ltd.
You must use our website only for lawful purposes and must not attempt to interfere with its security, operation or functionality.
You are responsible for ensuring that information supplied when placing an order is complete and accurate.
We reserve the right to restrict or terminate access to our website where we reasonably believe misuse, fraud or unlawful activity has occurred.
SECTION 2 – PRODUCTS
We sell grocery products and may also sell fresh, chilled, frozen and perishable products including meat, poultry, fish, fruit and vegetables.
Fresh products may be cut, cleaned, prepared, portioned or packed according to a customer's order.
Product photographs are provided for illustration. Because many of our products are natural food products, their exact appearance, colour, size, shape and weight may vary.
Product packaging may occasionally differ from photographs displayed on our website where manufacturers or suppliers have changed their packaging.
Where products are sold by weight, reasonable variations may occur due to the nature of fresh products and preparation.
SECTION 3 – PRODUCT AVAILABILITY
All products are subject to availability.
If an item becomes unavailable after an order has been placed, we may contact you to arrange an appropriate substitute, remove the unavailable item and refund it, or where necessary cancel the affected order.
Where a proposed substitute would materially differ from the product ordered, we may contact you before making the substitution.
We reserve the right to limit quantities where reasonably necessary.
SECTION 4 – PRICES AND PAYMENT
All prices displayed on our website are in pounds sterling (£) and include VAT where applicable, unless otherwise stated.
Prices, promotions and product availability may change from time to time.
The price charged will normally be the price displayed at the time your order is submitted.
We reserve the right to correct genuine pricing, description or promotional errors.
If an obvious pricing error affects an order you have placed, we may contact you before dispatch to offer you the option of purchasing the product at the correct price or cancelling the affected item or order for a refund.
Payment must be authorised before an order is processed.
Payments are handled through the payment methods and payment providers made available at checkout.
SECTION 5 – ORDERS AND ACCEPTANCE
After placing an order, you may receive an email confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
We reserve the right to reject or cancel an order where reasonably necessary, including where:
• A product is unavailable
• Payment cannot be authorised
• Incorrect pricing or product information has been displayed
• We cannot deliver to the address supplied
• We reasonably suspect fraud or misuse of our website
• Accepting the order would breach applicable law
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.
SECTION 6 – FRESH, CHILLED, FROZEN AND PERISHABLE PRODUCTS
Many products sold by Adam Afro Foods Ltd are perishable.
Fresh meat, poultry and fish may be cut, portioned, cleaned, prepared or otherwise processed specifically for an individual customer's order.
Customers should check their delivery promptly upon receipt and refrigerate or freeze products as appropriate without unnecessary delay.
Customers are responsible for following storage instructions and maintaining appropriate temperatures after delivery.
We cannot accept responsibility for deterioration caused by products being stored incorrectly after successful delivery.
If you believe a fresh, chilled or frozen product has arrived in an unsafe or unacceptable condition, please do not consume it and contact us as soon as reasonably possible.
SECTION 7 – DELIVERY
Delivery options, charges, geographical coverage and estimated delivery times are shown on our website and in our Delivery Policy.
Local deliveries may be made using our own delivery service, while nationwide deliveries may be fulfilled using third-party courier services.
Delivery dates and times are estimates unless expressly stated otherwise.
Customers are responsible for providing a complete and accurate delivery address, postcode, telephone number, email address and any necessary delivery instructions.
For perishable deliveries, customers should ensure that someone is available to receive the order or that suitable delivery instructions have been provided where permitted.
Where a delivery cannot be completed because incorrect information was supplied, nobody was available to receive a temperature-sensitive order, or suitable arrangements were not made, our ability to provide a refund or replacement may be affected, subject always to your statutory rights.
Please see our Delivery Policy for full details.
SECTION 8 – CANCELLATIONS
Your cancellation rights depend on the products ordered.
Under UK consumer law, the usual right to cancel an online purchase may not apply to goods that are liable to deteriorate or expire rapidly and may also not apply to certain goods made or prepared to a customer's specification.
Because fresh meat, poultry and fish may be cut or prepared specifically for an order, cancellation may not be possible once preparation has begun.
If you wish to cancel an order, please contact us as soon as possible at:
info@adamafro.co.uk
Where cancellation rights apply and cancellation remains possible, we will process the cancellation accordingly.
Nothing in these Terms affects your statutory rights.
SECTION 9 – REFUNDS, RETURNS AND PROBLEMS WITH ORDERS
Fresh, chilled and frozen products cannot normally be returned simply because a customer has changed their mind where the relevant statutory exemption applies.
This does not affect your rights where products are faulty, damaged, incorrectly supplied, not as described or otherwise fail to meet your statutory rights.
If there is a problem with an order, please contact us as soon as reasonably possible and provide:
• Your order number
• Details of the affected product
• An explanation of the problem
• Photographs where these may help us investigate
For non-perishable grocery products, applicable cancellation and return rights will be honoured in accordance with UK consumer law.
Where a refund is approved, it will normally be returned to the original payment method.
Please see our Refund and Return Policy for further information.
SECTION 10 – SUBSTITUTIONS
Occasionally a product may become unavailable after an order is placed.
Where appropriate, we may offer a suitable substitute.
Where a substitute would materially differ from the product ordered, we may contact you before making the substitution.
Where no appropriate substitute is available, the unavailable item may be removed from the order and the relevant amount refunded.
SECTION 11 – FOOD INFORMATION AND ALLERGENS
Product descriptions and ingredient information are provided to assist customers.
Manufacturers may change ingredients, recipes, packaging or allergen information without prior notice.
Customers with allergies or intolerances should therefore always check the product label, ingredient information and packaging received before consuming a product.
Where products are prepared or handled by us, reasonable procedures are followed. However, unless expressly stated otherwise, we cannot guarantee that products have been prepared in an environment completely free from traces of particular allergens.
If you have a serious food allergy and require further information before ordering, please contact us before making your purchase.
SECTION 12 – WEBSITE INFORMATION
We take reasonable care to ensure that information displayed on our website is accurate.
However, occasional errors may occur in product descriptions, photographs, prices, availability, weights or other information.
We reserve the right to correct errors and update information where necessary.
Product images are illustrative and packaging may differ from images displayed online, particularly where manufacturers update their packaging.
Nothing in this section affects your statutory consumer rights.
SECTION 13 – CUSTOMER ACCOUNTS
Where our website allows customer accounts to be created, you are responsible for maintaining the confidentiality of your login details.
You must provide accurate information and notify us if important account information changes.
Please contact us promptly if you believe your account has been accessed without authorisation.
SECTION 14 – PROMOTIONS AND DISCOUNT CODES
Promotional offers and discount codes may be subject to additional conditions, expiry dates, minimum order values or product exclusions.
Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other promotions.
We reserve the right to withdraw or correct a promotion where there has been an obvious error, misuse or technical problem.
SECTION 15 – THIRD-PARTY SERVICES AND LINKS
Our website may use or link to services provided by third parties, including Shopify, payment providers, delivery companies, analytics providers, advertising platforms and social media services.
Third-party websites and services operate under their own terms and privacy policies.
We are not responsible for the content or operation of third-party websites that we do not control.
SECTION 16 – INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website, including text, branding, graphics, photographs, design and other original materials owned by Adam Afro Foods Ltd, is protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes.
You must not reproduce, distribute, commercially exploit or substantially copy our website content without our permission, except where permitted by law.
Product names, logos and trademarks belonging to third-party manufacturers and suppliers remain the property of their respective owners.
SECTION 17 – PROHIBITED USE
You must not use our website:
• For unlawful or fraudulent purposes
• To transmit viruses, malware or harmful code
• To interfere with the website or its security
• To attempt unauthorised access to systems or accounts
• To collect information about other users without lawful authority
• To infringe intellectual property rights
• To place fraudulent or deliberately misleading orders
• To impersonate another person
• To interfere with the normal operation of our website
We may restrict or terminate access where we reasonably believe the website is being misused.
SECTION 18 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.
If you are purchasing as a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
We are not responsible for business losses suffered by consumers, including loss of profits, revenue, business opportunities or business interruption arising from products purchased primarily for personal use.
Nothing in these Terms affects your statutory consumer rights.
SECTION 19 – EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delays or failures caused by circumstances outside our reasonable control.
These may include:
• Severe weather
• Road or transport disruption
• Courier network disruption
• Industrial action
• Power or telecommunications failures
• Government restrictions
• Emergencies
• Other events that we could not reasonably prevent
Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
SECTION 20 – PERSONAL INFORMATION
Our collection and use of personal information is governed by our Privacy Policy and Cookie Policy.
Personal information may be shared with service providers where necessary to process payments, fulfil orders, arrange deliveries, prevent fraud or operate our website.
Please refer to our Privacy Policy for further information about how personal information is handled and your rights.
SECTION 21 – CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our business, website, services or applicable laws.
The latest version will be published on this website.
Changes will not normally affect orders already accepted before the updated Terms became effective, unless required by law.
SECTION 22 – SEVERABILITY
If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions will continue to apply.
SECTION 23 – WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
SECTION 24 – GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales.
If you are a consumer, you will retain any mandatory legal protections and rights regarding jurisdiction available to you under applicable UK law.
Nothing in these Terms removes or restricts rights that cannot legally be excluded.
